hi guys,

This time I am posting for info regarding issues of my friend. 
My friend is in Nepal. His girlfriend is in the US, she has a US green card. Now, what are the possible paths for his immigration to the US? They want to get married asap but the girl don't want to travel to Nepal because she has no relatives overthere. Please suggest all the possible ways for him to come to the US and acquire green card. Also how long it takes to process ? Please please help!!! Eagerly waiting for answers, thank you very much for reading and trying to help...

yah your friend's spouse can definitely file I-130 even if your friend is in Germany, as he is Permanent Resident of Germany I believe he can definitely apply for his immigrant visa in Germany itself and travel to USA instead of being required to travel all the way down to Nepal.

Hello Gurus:


Apologies to bring this month old thread back but I do have a few question the gurus here may be able to help me with. So, here's the scenario similar to the one of the poster of this thread.


Girl is in Nepal. Guy is in the US in PR. The Guy goes back to Nepal and get married. If I understand it correctly, here's how the process works.


1. Get married.


2. With the marriage certificate and all the applicable documents, apply for





I-130 Petition for Alien Relative


in US Embassy, Kathmandu.


Approximately 5 months is the processing time for this currenlty.


3. I-130 gets approved in 5 months.


4. Wait another 5-6 months for the visa to become available.


Here's my question, once I-130 is approved, does the girl need to fill up any forms or simply wait for call/letter from the embassy for the visa to become availble. Can someone give me detailed picture from step 3 to the issuing of the green card.


Much appreciated.

One of the good posts coming down here. Thanks all gurus for posting such valuable information. How about this scenario which is happening to my fren?


 


- Guy on H1B in US


- Girl on student visa in Australia


- Marry in Nepal


How can she come to US and get authorized to work here in US? Btw, the girl is doing nursing so how hard/easy is to get work visa for her after she comes to US?


 


Any suggestions/help is appreciated.

Your have some mis information after step three; so let me correct you.


Step one---Get Married


Step two-- Create a marriage certificate and other civil documents


Steps three--Guys should come to US (For faster processing) and apply for I130.


Step four--- after the approval of I130 wait for the visa dates to be current (Notes: Your priority date will be the date that you applied for I130--not the approval date; so even if you have to wait for 5-6 months(just in case), then you do not have to wait for visa date(as of right now; waiting time can be changed in fuutre)


Step five---when your priority dates started to come close to current; NVC will send you an email/mail leting you know how to pay the fee for affadavit of supports.


Step six--Pay the fees (if i am correct; it's either $70 or $80)


Step seven-- wait for almost a month, NVC will contact you again


Step eight-- NVC will ask you for the payment of $400 for the applicant's processing documents.


Step Nine--Pay the fees


Step Ten-- Print the receipt (both the applicant's processing documents and affadavit of support) and then submit all civil status documents (Police report, birth certificate.., marriage certificate,etc) with application forms DS230 and send it to NVC (from Nepal).


Step Eleven--Guys should submit I864(depending on his last year income) and proofs of income to NVC (Sending through email will be quicker)


Step Twelve-- If all documents are in order; NVC will send you (In Nepal) a package with information on doing the medicals and will also provides an interview date.


step Thirteen--- Do the medicals


Step Fourteen-- Go to the interview with documents that NVC send to Nepal.


Step Fifteen-- If everything is in order, interview will just be for formality.


Step sixteen-- Get the PR visa


Step Seventeen-- come to the USA and apply for a PR card at the port of entry.

Sagarmatha1: You are the man. Depth of your knowledge is just awesome.


So US Embassy in Nepal get involved only from Step 12, right?


If things remain unchanged from what it looks like today, how long does it take from the time you apply for I-130 (Step 3) to the time you get the PR visa (Step 16)?

I will say it will take approximately about a year for her to get a Green card if everything goes according to the plan.


As far as I know, US embassy will be involved only after Step 12.

You have two option.


For her to come to US


First Option


Step 1--You both guys can go to Nepal and get married.


Step 2-- She can come to United States from two different ways; apply as a student and come here and join college here. After a year, she can file for a work permit ( part time -saying her financial circumstances changed). If she can provide right documents, she will be approved. But she will be in F1 status and she has to follw F1 rules.


Second Option:


Step1-She can come to US in a toursit Visa/Student visa. You guys can get married here.


Step 2-- If she does not want to be in a student visa, she can change her status to dependent visa. She neither can not go to college nor can work here.


To Work here


If nothing changes and if everything stand as if it is


If she has completed her nursing degree from Australia; she can join grad school. Apply for CPT and work.


If she is an undergraduate and is still going college, she can apply for OPT after she finished colleges here and work for 1 year and then join grad school.


Or if Congress changes the law on coming years; then there can be comepletely different scenario.

Here's what he was thinking of.


- She comes here in US from AUS as a tourist.


- She and him gets married in court with marriage certificate


- They get married in Nepal


- She finishes nursing in AUS


- She comes as a dependent


How hard it is to find a job here in US after she completes her nursing in AUS? She's got experience as well in nursing field.


I heard that the nurse graduates can take some exam here for practicing nursing and get job? Can you enlighten me with your knowledge.

If she comes to the United States as a dependent, then legally she will not be allowed to work.


She needs to take an NCLEX exam and pass it to be a registered nurse.


The best bet for her at that time will be to change her status to F1 and go to graduate school and start working with the CPT.(Assuming the law will be as it is.)


(Before 4 yrs ago--she could apply for GC directly but that's long gone)


Is there any possibilty for your freind to get a green card from his status as H1B? or even apply for it... then there can be different route(some possibilities) for your freind and his future wife.

Yeah, she won't be allowed to work on dependent exam.


As you said, she had to take that NCLEX exam. Do you know how hard it is to pass that test? I personally think it is better off that way then change into F1 status, go to school and find for nursing job.


For my fren to get h1b, it's a long shot. May be he will get it within4,5 yrs but not sooner than that. That's for sure.


Also now another question,  i hope if you don't mind. He is in h1b with decent consultancy and currently on project. How big is the risk if he goes back to nepal for stamping? I heard lot of people get stamped from Canada/Mexico? What are the risks on that?


Sorry to bother you man but being an immigrant i guess sucks big time here.

Believe me, its tough and then again I am not sure if she can take NCLEX after her completion of her studies in Australia. She may need to take couple courses before she took the exam. And even after her passing the NCLEX, she will not be able to work unless she change her status or else if the law gets changed.


With descent consultancy,  I will say he should not have any problem but again sometimes you never know. Applying from Canada is fine too; I have seen people doing it with no problem.

Hmm, didn't know that NCLEX exam would be so hard as lot of nepalese students graduating from nurse in Nepal were getting nurse jobs easily but she might give a shot to see if what happens. Also i heard that after she passes, if the company is eager to file for her work visa, she might be able to work but again, don't know. Englighten me again :).


 


Yeah, he's been a project with the decent consultancy but again i have heard that so many consultants are rejected for visa stamping although they are on a project so he is kinda of scared about it. Do you know what kinda of documents does he need to present such that his chance of getting approved would be higher?


For visa stamping in canada/mexico, i might have to create another thread.

For the first part, as it is, companies will  be allowed to file a work visa for her but she will not be allowed to work until her visa becomes current. To make long story short; she will not be allowed to work even if a company is ready to file for her.


Companies can not file H1B visa for her because Registered Nurse as it is is an associate level job. Companies can not file H1B visa for any associate degree level job eventhough she may has a Bachelor's degree. If a hospital can shows that the job she will be doing needs a Bachelor degree (some hospital especially in the state of New York specifically ask for Bachelor's degree) and is willing to sponsor, then on that circumstances, the company can file for H1B visa and only then she can work.


Law can be changed as there are some discussion happening on Congress but until that happens, its a tough shot.


For the second part, I do not have a whole lot of information on specific documents but as far as i know just some concreate evidence regarding his profession, his degree and his consultancy will be a huge plus.
