Dear All Sajha members,

I was physically assaulted and robbed. Police came and they initiated the case. They are searching the suspect and I am helping them out in their process. I heard that I am eligible for applying U-Visa. Is this good option? I am in F-1 status in TPS. Suggestions and experiences are really appreciated.

By the scenario you mentioned, you have a strong case. But you have to gather all the proofs of assault and your cooperation to the law enforcement agencies.
Yes, you can apply for U visa regardless of your current status but keep in mind, the u visa processing is really slow.
You're looking at around couple years to get your turn, at least.
I'm not an attorney so please take it as a suggestion rather than a legal advice.

U visa has a huge backlog. Currently it is at 78000 ( on criminal activitied based) with only 10000 visa for the entire U category per year. Please consult a lawyer for finding your realistic chances.

Thank you @brk and @maxpayne. It was very professional suggestions. My spouse is in the US for last four years. Do you guys any idea about applying U visa for spouse, like U-2 ? What is the chance of getting U visa for me and for my spouse? When does U visa applicant and u visa dependent get EAD? If you guys know the answer, could you please share with me?

You can apply for your wife at the same time you apply U visa for yourself.
If you think, you meet all 4 requirements to get U visa, you have good chances. ( you can find the requirements on USCIS website). If it gets approved, your wife's application will be approved as well.
They are processing June 7th, 2014 cases right now. So if you apply now, you might have to wait 2 and half more years to get your turn. If you get approved, you will get the EAD with deferred status and have to wait until there is any quota left for your case.
Please consult an attorney if you need a legal advice or have a complex case. Filing U visa by yourself can be a little tough sometimes if the case is not straightforward.
