Folks:

Just wondering if anybody is using their iPhone without the data-plan from ATT but using their own WiFi? My two-years contract is about to expire and I was thinking of saving some bucks for opting out of the $30 a-month data plan but rather using my own WiFi at home and work. I was told by ATT staff that ATT will find out that I have been using an iPhone with their service and hence will charge. Any thoughts? Help appreciated!!!

I just had a word with representative from AT&T....There is no way you can used any smartphone without data plan...If you put your SIM Card  in any other smartphones you will automatically  see the data plan charge on your bill you do not even have to make any calls....That is what it happened on my last month bill...so better get the $15 data plan which gives you 200mb Data plan use for a month...as you said you have wifi on ur office and work that should be more then enough.

Yes AT&T will find out that you are usinf WiFi from their device for free and will charge you 30 dollars a month. So, it wont work. My friends tried to be smart the way but ended up paying for data plan.

if your contract is over just swich to different carrier. Go to jaiklbreakme.com from your safari browser and then unlock it. its the easiest jailbreak and after that use 
full instructions and video at the link.

i have a million dollar suggestion for u and others who need help in this regard, few of my friends did this and it worked, first they called atnt and asked to block internet from their lines (u can give any reason, son keeps on playing with it, wife surfs porn bla bla bla), so once internet is blocked in ur line, u can use the same sim card in an unlocked iphone, atnt can't find out that u r using an iphone,
this method has worked for other smartphones as well

I did what man ko kura said, and still att detected my iphone. I was reading somewhere, whenever u connect ur iphone to itunes it sends ur imei number to att and thats how they find it out, not sure if this is true. There was a hack called ziphone for iphone but its available for iphone 2g and below that fakes ur imei and att will think its some non smart phone. Good luck, let me know if got it working.

Yes, ATT can easily track that you are using wifi without data plan. You wouldn't be surprised to get bill inclusive data plan for next month.

Better to follow KJ's advice to save, though it's little.

Guys,
not sure if you already know that the U.S Copyright Office ruled that
jailbreaking a phone is now Legal. So, ideas suggested by maxpayne could be good option if you want.

if your contract is over...heres what you do.  switch over to any other company besides att and vz.  unclok your phone  buy data plan if you want to if not you are fine....but if you want to stay with ATT and it will be a constant battle...as your phone will keep showing up as smartphone.

First unlock your iPhone. Get a non smartphone. Put your AT&T sim into it. Call customer service' with that non smartphone. say you lost iPhone. You wAnt to use your old phone and remove the data plan from it. They ask you the imei of your new phone which you are using to call them. Say you can't get the battery out while stillon the phone with him/ her because it will disconnect the call. If they ask you to punch in some codes from your phone while the call is still active say # or * key don't work on your phone. Now AT&T can't register you with a particular phone. This means when you insert your sim in any smartphone even iPhone they wont track or may be don't know. I did this in 2009. Dont know what they are up to now. Using droid now, love it. Miss the app store though.

I dont know if it is metioned in terms and condition when we signed the at&t contract that if you have a smartphone you must have a data-plan on it?

and other designated smartphones. Eligible data plans cover data usage in the U.S. and do not
cover international data usage and charges. If it is determined that you are using an iPhone or
other designated smartphone without an eligible data plan, AT&T reserves the right to add
an eligible data plan to your account and bill you the appropriate monthly fee.
