 US green card between EB2 or EB3 category

Is there any time difference for an H-1 Visa filling US green card between EB2 or EB3 category? If so is there time difference for the same for Nepalese or Indian or some one from any other Nation. I heard we all share same amount of available quotas despite the county of birth. Guys any suggestion appreciated.

GC will take:

EB2 - 2-3 years
EB3 - 4-5 years

I don't know of any time difference depending on citizenship.

EB2: 6 to 9 months.

Are you saying 6-9 months in practical case or in ideal case (meaning, by looking immigration guidelines)?
Do you know any nepali who got it within such a short period?

The application depends on which country you were born rather than the Country citizenship

Chatmandu, I hope you are rite regarding EB2 cases. Started labor on June, 06 now waiting for the I485 approval. I hope my case didn't get stuck on namecheck :=)

I guess GC processing ( employer based) goes through follwoing phases:

1. Labor certification
2. I-140
3. I-485

Labor certifcation used to take maximum time ( 1.5 years in my case). Now with PERM what is the state, I do not know. In my case I-140 and I-1485 was adjusted in the same day as I got a RFE. My case was EB2 based

My friend got gc in six months after filing i-485 through his employer. It was an EB2 case. it is pretty good now. If you can qualify under EB1, it is the swiftest right now and you (except Indian/Chinese/Mexicans) get it in three (3) months. My university filed my I-485 at the start of November and I got the real thing in my home address last week.

Hello Simonsaurav what are the chriteria for EB1...
PH.D. with couple of publications in science field works for EB1.
Is job necessary?
What else are the basic things needed?

Hi Gorkhali,
There are three groups within EB1: those with international awards, etc. (like Nobel Prize or lesser but highly competitive prizes in your field); outstanding professor/researcher (usually with tenure track job with a research university or research organization; and then the national interest waiver in which case you have to demonstrate that your staying in this country will benefit the US in significant ways. To file under any of these categories of EB1, you have to have a Ph.D., a few good publications in reputed journals in your field and 5-10 strong recommendation letters from highly reputed scholars in your field. Some awards and membership in professional organization also helps. Getting letters from top researchers and documenting all your achievements (including publications) can be a bit hassle but, hey, it's worth it. You can apply without a job offer if your other credentials are strong, but if you have an offer that'll sweeten things.

Are you sure about that, SimonSaurav? I thought Outstanding Researcher and National Interest Waiver category fall under EB-2 category.

I wonder what the time frame is like for EB-2 nowadays with PERM. Anybody care to enlighten?
