The International student advisor at Cameron University has given A SEVIS TERMINATION AND OUT OF STATUS letter to two of the current students stating that they were involved in offcampus job. Both of the students are in F-1 status . What are the options for these students to be in status again ? We entire Nepali students in Lawton, Oklahoma are waiting for your views and comments .

Contact an Immigration Lawyer immediately. Tell him/her that you had accepted off campus employment (and of course about the letter). Ask what is needed to reinstate your status. I remember reading that your advisor won't let anyone transfer anywhere else. File a complaint with USCIS (through your lawyer). Good Luck !! Your Tuppi

CONTACT RAJIV Khanna, the top immigration lawyer in USA. He is in dallas I rememeber she was distributing that sorts of letter to the employer couple of months ago. Why don't you guys all transfer to some nearby university. You got to bust their ass. DOn't forget to spread this information back in nepal that cameron is no more the good college for we nepalese. THey will not get any international students from Nepal.

Jayamatadi and Tuppi first of all we would like to thanks for your suggestions. We went to an immigration Lawyer in Oklahoma City and showed him the letter. He said its upto college decision and we are really hopeless. We are going asa delegation team to the president office on Monday. we are hoping it might help us . By the way would you please give us the contact information of Rajiv Khanna , we would go there and meet him. Its just 3 hours drive from our place. We will be updating our information through this blog.

First: Out of Status and Sevis termination are NOT deportation proceedings. Second: Deportation proceedings occur when you are served with NTA (Notice to Appear) No one has mentioned about NTA here, and I am sure school lacks jurisdiction to issue NTA. The students there are out of status (or not even that). Only the letter can tell that. The options are: Take transfer to different university If not, file request to reinstatement with DHS, and claim that Intl. Advisor erroneously terminated you from school without having any proof. A school cannot terminate SEVIS verbally for unjust cause. Or, email me.

If you go out of status coz of working out of school, and your school, doesn't help you , its almost impossible to get reinstated. Most reinstatement are done on the recommendation of Int Advisors of school. So I would rather try to settle everything within the schoo,boundary, and then transfer out as soon as it is solved.

Shrivastav and Crystalcracker Thanks for your valuable comments. We showed the letter given by our DSO to two immigration lawyers at Oklahoma city. They gave us the option to go through the student hand book provided by the college to the students. On one of the code states: Nonacceptance of Administrative Disposition. If the student chooses not to accept the Director of Student Development's decision, the student has seven (7) consecutive calendar days after the notification of the decision is mailed in which to file a written appeal to the VP/SS. In the event of suspension or expulsion, if the President has not heard the case or read the record, a final adverse decision may not be made until the student is given an opportunity to present his case to the President. Please refer to section 3.03(c5) for more details. We are trying to go through this and request the college. Immigration lawyers have said us that the college have full powers on us and have given this letter. After 15 days of the letter recieved the INS official will take the students on custody and give them two options: leave the country and return immediately OR have a right to hearing in the immigration court at Oklahoma city. On the other hand the DSO have mentioned the following sentences in her letter."Due to the federal guidelines regarding illegal employment regulations, you will not be eligible for reinstatement . You must return to your home country immediately or risk deportation by the bureou of Immigrations and customs Enforcements(ICE) We are in dilemma

The major condition for reinstatement to be approved is: 1. The student must be able to show that the cirsumstances which led to it were out of his control. which is not the one in your case.So once you get out of status, you will have lilerally no chance of getting back to stauts. So 1. Talk to your VP and confess and beg for a chance. If that doesnt work, good luck!!!

Sorry to hear about the situation pokhara22. First and foremost, ONE HAS TO CALM DOWN and see the situation like it is. You did break the law, which I'm sure almost all nepali students do in this matter. You are just unlucky to get noticed.You need defense. Heres how you should proceed:( 2 ways) 1) Beg for mercy to the college authority, to someone who has power to intervene in the situation, and someone who's at least open minded. It could be the president him/herself or vice president, dean etc.. This is the easiest route since all you need to do is beg. It wont cost you any money which I'm sure you need as a student. Mediation is always better than Litigation. 2) You can hire an aggressive lawyer who specializes in removal proceedings. Immigration law is complex and there are sub- divisions. Dont hire a lawyer who does removal defense and also does bankrupcy, real-estate. Downside of this is that it will cost you time and money. This should be the second option. Immigration laws are governed by FEDERAL LAWS so you can hire any competent attorney from any parts of the United States. Also, Nepalese seem to think Indian lawyers are less expensive, and can fix anything. Dont fall for that. Its my personal opinion that that might actually charge you more since you are so receptive to his/her services. I've heard a lot about http://www.shusterman.com/ though I personally don't have any experience. Also, just google "top deportation defense attorney" or something and you should see further links.... Cause brother, if things go wrong, thats where you are heading..into deportation. good luck.

We are really losing the hope to be re-instatement. They were employed by one of the Pakistani. This Pakistani named is a librarian at Cameron. The international student not only caught these two students. Other five students were also caught working in various places. The DSO gave a notice to all the employers including the Pakistani that these students are illegal to be working. The other employers in other places fired the other Nepalese as soon as they recieved the all from DSO. The pakistani trying to be smart went to various departments in college and said that they were working for him as other Nepalese were also working in several places in paycheck . The person whom the pakistani met were the people from in the post above than DSO. They arranged for a meeting and the meeting decided to make the students terminated. When we talked with the DSO , she mentioned that if she was only the one to know ; she would have just leave the student with a warning like other students. There are two mistakes the pakistani commited which led to this seveare action 1. he would have fired the students like other employers and said the student are not working anymore. 2. he didnot said the students anything about whats going on until they got the letter to be Terminated. We know that there was a meeting including Vice president, DSO, the pakistani and other official. The meeting was the one to decide everything. BUT THE PAKISTANI CONTINUED TO MADE THEM WORK UNTIL THEY WERE TERMINATED. WE WENT TO THE PAKISTANI AND SAID HIM PLZ HELP US OUT. GO TO THE VPS OFFICE AND SAY TO HIM THAT THE STUDENTS WERE JUST HELPING HIM FOR 2-3 DAYS. HE IS REFUSING EVERY OF OUR REQUESTS. THE LAWYERS AND OTHER PEOPLE WE TALKED ARE ALSO SAYING THAT HE IS THE ONLY ONE THAT CAN HELP. BUT FOR HIM HE IS SHOWING ATTITUDE. WE ARE REALLY HELPLESS AND WE BEG MERCY WITH ALL TO GIVE US SOME SUGGESTIONS AND GET OUT OF THIS TROUBLE.

Situation seems to be more complex than I had thought initially. Ask the Pake what he wants from you guys. He may be just wanting some money or something. I am not saying that you pay him, but it wouldn't hurt to find out if you can.
