Back to school or visitors visa if u r talking from immigration prespective.

dont' give up...keep looking for other jobs...apply at as many places as you can...who knows what might turn up...

in the mean time, have a backup plan...search for a college if you were in OPT or in H1...

How long can you stay in H1 without generating payroll. H1b hold by desi company. If some one has a reliable source of information plz share.

Technically you are out of status the day you are terminated from work. But usually USCIS overlooks a small gap in employment. Act fast to change to other nonimmigrant status. You can look for a job, once you get your new employer to file your H1-B,  you will not be counted against the H1-B cap. Once filed, you can start working for your new employer.

It's been over 2 months, No more severance pay by this week.
