I have applied for H1B through a consulting firm. My application is still under review by the immigration (USCIS). I am not very happy with this consulting firm, so I would like to tell them to cancel my H1B (before October 2007), before I start working for them.

Will this put me out of status? I have never worked for them.

Currently, I am on my OPT which is valid until June 2008. I am seeking employment in a non-profit company (which is exempt form the quota).

Thank you for your help!

One you need to tell them to cancel if you do not want to process your H1 app.
Next if you get H1 I am not sure if issuing I-20 will put you back in F1 status.I think you have to apply for change of status from H1 to F1. So consult with your International Student Advisor.
